Jameis Winston Rape Case: No. 1 Draft Pick Files Lawsuit Against Accuser
The Jameis Winston rape case took an unexpected turn on Monday.
In April, just two weeks before the 2015 NFL Draft, Erica Kinsman, the woman who accused Winston of raping her back in 2012, filed a civil lawsuit against Winston alleging rape, assault, false imprisonment, and emotional distress. Now, the top pick in the NFL Draft has filed a counterclaim against his accuser, saying she is just trying to get rich and tarnish his reputation.
“Ms. Kinsman has made the false statements in an effort to cause damage to Mr. Winston’s reputation and to coerce and extort him to give her money and ‘make her go away,'” Winston’s attorneys wrote. “Ms. Kinsman was aware that Mr. Winston was likely to earn a substantial amount of money in salary, bonuses, and endorsements as a professional NFL football player.”
“Ms. Kinsman has been successful in one major area,” the filing continues. “She has mounted a false and vicious media campaign to vilify Mr. Winston with the objective of getting him to pay her to go away.”
Kinsman, a former student at Florida State, says she was drunk when she met Winston at a Tallahassee bar in December 2012 and went with him and others to an apartment, where she maintains he raped her. However, Winston has insisted that they engaged in consensual intercourse, and Florida prosecutors failed to press charges.
Normally, of course, we would not actually name someone who claims she was the victim of a sexual assault. However, Klinsman recently came forward and identified herself in a documentary film, so it seems appropriate to include her name here.
I am in no position to comment on the veracity of the rape accusations, because I’m not a lawyer or a cop involved in the original investigations. However, for those who assume Erica Kinsman is just after Winston’s money because she filed a civil lawsuit just weeks before he signed a $23.35 million contract, I will point out that she has also sought to have criminal charges filed, and she has filed a Title IX complaint. And neither of those courses of action would have made her any money. So you have to admit it’s at least possible Kinsman just wants to have the man she believes raped her brought to justice.
