NFL linebacker Aldon Smith simply cannot stay out of trouble.

The 49ers washed their hands of him in 2014 after numerous arrests for DUI, hit-and-run, vandalism, and making bomb threats at LAX. Smith was then picked up by the Oakland Raiders for the 2015 season. However, he was suspended for the 2016 and 2017 seasons, and the Raiders finally cut him in March after he was arrested for a domestic violence incidence in which he allegedly bit his fiance.

Aldon Smith’s latest legal issue arose last week, when he was arrested again for violating the conditions of his bail in the domestic violence case. Now we know the details of that arrest, and they are pretty insane.

According to San Francisco prosecutors, Smith was supposed to report to the sheriff’s department last Friday to get fitted for an alcohol monitor. And he did show up. But apparently he was absolutely plastered.

At a court hearing on Wednesday, assistant DA Courtney Burris said Aldon Smith had a blood alcohol content of 0.40 when he showed up to the sheriff’s department, and while he was in their custody it rose actually to .41, roughly five times the legal limit of .08.

So just how drunk is a .41 BAC? Take a look at this chart courtesy of the student wellness center at the University of Notre Dame:

Basically, Aldon Smith is lucky he’s not dead.
