49ers LB Ahmad Brooks Charged With Sexual Battery, Ray McDonald Indicted for Rape
Things just keep getting worse for the San Francisco 49ers as they could now be without linebacker Ahmad Brooks after the former Pro Bowler was charged with sexual battery as a result of his involvement in the Ray McDonald rape case.
In addition to charging Brooks, prosecutors also announced that they have indicted McDonald on a felony rape charge (for an incident with the same woman). According to her lawsuit, here’s how it all played out following a pool party at McDonald’s San Jose home back on December 15:
Contrary to media reports, she contends, she did not pass out from drinking but slipped and fell on a “negligently maintained, dangerously slippery deck” near McDonald’s swimming pool and struck her head, passing out for eight minutes. She also claimed the video shows that McDonald believed her to be dead. But instead of calling 911, she alleged, he told others at the party that he did not want a dead woman to be found on his property.
In her lawsuit, the woman contended that after passing out by the pool, she regained consciousness but fell several more times as a result of both the head injury and her alcohol consumption. It claims that while she was unconscious from one of those falls, Brooks groped her in a “sexual manner.”
Then, before she fully regained consciousness, McDonald carried her to his bedroom and had sex with her, she alleged. The woman’s suit does not mention whether the couple had sex the next day, though a police report in the case claims they did but notes she was not initially aware of what had happened while she was passed out.
If found guilty, Brooks could face up to six months in jail and be forced to register as a sex offender. As for McDonald, he faces a maximum sentence of eight years if convicted of felony rape.
McDonald was cut by the 49ers back in December as a result of the incident, and after being picked up by the Chicago Bears in May, he was cut by them as well following a domestic violence arrest that resulted from an altercation with his ex-fiancee in Santa Clara.
As for Brooks, he remains a member of the 49ers for now, but the team has sent him home to California for the time being and they have also announced that he will not take part in Saturday’s preseason game against the Denver Broncos.
