Carlos Martinez is the subject of a $1.5 million civil suit wherein his on-again, off-again lover claims that she tested positive for STDs in the days following a December tryst.
According to the suit, the two reconnected last year — and began having sex again on Dec. 16th. Two days later, the woman claims she began to feel ill and later tested positive for multiple STDs.
Soon after the woman informed Martinez about her condition, he allegedly bolted for the Dominican Republic and never called her back.
The lawsuit filed in Miami seeks more than $1.5 million and accuses the pitcher of a negligent transmission of a sexual transmitted disease. It seeks actual and special damages along with mental anguish and exemplary damages. It also seeks punitive damages because of outrageous actions. His accuser is from West Palm Beach, Fla., not far from the Cardinals’ spring training home in Jupiter.
Martinez’s attorney Ruben Scolavino told TMZ that his client is being falsely accused.
“I can tell you most assuredly the allegations are 100 percent false.”
Via TMZ, the West Palm Beach woman said to the courts:
“He Swore to God that he was not infected with any sexually transmitted diseases.”
Martinez pitched on Sunday as scheduled battling the flu and this lawsuit suffering his first loss of the season.
